In the actions of the staff of the MF SU in the Central Administrative District of the Ministry of Internal Affairs of Moscow, who lost personal belongings of Shprygin A.I., seized during a search in his apartment, there are signs of a crime under Art. 293 of the Criminal Code - Negligence, that is, failure to perform or improper performance by an official of his duties as a result of an unfair or careless attitude to the service or duties in the office, if this entailed causing serious damage or a significant violation of the rights and legitimate interests of citizens or organizations or the interests of society protected by law or state.
In accordance with Art. 151 Code of Criminal Procedure, the above article refers to the jurisdiction of investigators of the Investigative Committee of the Russian Federation. As follows from the response of the Internal Affairs Directorate for the Central Administrative Department of the Ministry of Internal Affairs of Russia in Moscow, the materials of the internal audit on the fact of the loss of the seized things have already been sent to the investigation department of the Investigative Committee of the Russian Federation, which will be verified in accordance with Art. 144-145 of the Code of Criminal Procedure and a procedural decision was made on the situation under consideration.
In this regard, an additional statement of the crime is not necessary. At the moment, it is necessary to wait for the results of the pre-investigation check, the maximum period of which is 30 days.
