TERMS AND CONDITIONS OF USE.

GENERALITIES.
1.1. Privacy policy (hereinafter – Policy) is published by LLC "ELS" OGRN 1107746487640, INN/KPP 7703722933 / 773001001, location Moscow, Bagrationovsky proezd, 7 K. 20V, of. 317 (hereinafter – the Operator) to inform about the operator's policy regarding the processing of personal data of users of the operator's website – personal data subjects (hereinafter – the User). 
1.2. The policy was developed and published by the Operator in accordance with paragraph 2 part 1 of article 18.1 of the Federal law of July 27, 2006 № 152-FZ "On personal data" (hereinafter – FZ "On personal data"). 
1.3. The policy is designed to implement the requirements of the legislation in the field of processing and protection of personal data and is aimed at protecting the rights and freedoms of man and citizen in the processing of his personal data, including the protection of the rights to privacy, personal and family secrets. 
1.4. The policy contains information to be disclosed in accordance with part 1 of article 14 of the Federal law "On personal data", is a public document and is located at: fanshotline24.ru ahhh! 
1.5. In order to keep up to date the documents defining the operator's policy regarding the processing of personal data, the Operator has the right to change this Policy at any time by publishing the relevant changes. This Policy may not be modified except by posting the modified document on the Site. 

BASIC CONCEPT. 
2.1. Personal data – any information relating directly or indirectly to a specific or identifiable natural person (subject of personal data). 
2.2. Processing of personal data – any action (operation) or a set of actions (operations) performed with or without the use of automation tools with personal data, including collection, recording, systematization, accumulation, storage, clarification (update, change), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data. 
2.3. Personal data operator – independently or jointly with other persons organizing and (or) carrying out the processing of personal data, as well as determining the purpose of processing personal data, their composition to be processed, actions (operations) performed with personal data of Users. 
2.4. Confidentiality of personal data is the obligation of the Operator and other persons who have access to personal data not to disclose to third parties and not to distribute them without the consent of the personal data subject, unless otherwise provided by Federal law. 
2.5. Site – a set of programs for electronic computers and other information contained in the information system, access to which is provided through the information and telecommunications network Internet and located at: fanshotline24.ru ahhh! The Site may contain links to other Internet resources. The operator is not responsible for the confidentiality of information posted by the User on such resources.
 
USER RIGHT. 
3.1. The user has the right: 
3.1.1. To receive personal data related to the User and information related to their processing; 
3.1.2. To clarify, block or destroy his personal data if they are incomplete, outdated, inaccurate, illegally obtained or are not necessary for the stated purpose of processing; 
3.1.3. To withdraw his consent to the processing of personal data; 
3.1.4. On protection of the rights and legitimate interests, including on compensation of losses and compensation of moral harm in a judicial order; 
3.1.5. To appeal against the actions or omissions of the Operator to the authorized body for the protection of the rights of personal data subjects or in court.
 
BASE THE PROCESSING OF PERSONAL DATA. 
4.1 the Operator processes personal data on a legal and fair basis to perform the functions, powers and duties assigned by the legislation, to exercise the rights and legitimate interests of the Operator and the User. 
4.2 the Operator receives personal data directly from the User and processes them only with the consent of the User. The operator obtains personal data of the user when the User interaction with individual features of the Site. 

PROCESSING OF PERSONAL DATA OF USERS. 
5.1. This Policy establishes the obligations of the Operator to ensure non-disclosure and confidentiality of personal data that the User provides when using the Site.

5.4. Categories of personal data that the Operator collects to achieve the purposes specified in clause 5.2. Policies:

5.4.2. Name. 
5.4.3. Patronymic. 
5.4.4. Contact phone number. 
5.5. The operator does not process special categories of personal data of Users. 
5.6.      The operator does not process biometric categories of users ' personal data. 
5.7. This Policy applies only to information processed in the course of using the Site. The operator does not control and is not responsible for the processing of information by sites and services of third parties to which Users can click on links available within the Site. 
5.8. The operator does not verify the accuracy of the personal data provided by the User, and is not able to assess its legal capacity. However, the Operator assumes that the User provides reliable and sufficient personal data and keeps them up to date.
 
CONDITIONS OF PROCESSING THE PERSONAL DATA OF USERS. 
6.1. The processing of personal data of Users is limited to the period of achieving the purposes of processing. 
6.2. The operator processes personal data of Users in an automated way using computer technology. 
6.3. Actions to process personal data include collection, recording, systematization, accumulation, storage, clarification (update, change), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion and destruction. 
6.4. With respect to personal data of Users, their confidentiality is maintained, except in cases of voluntary provision Of information about themselves by users for General access to an unlimited number of persons. 
6.5. The operator has the right to transfer the user's personal data to third parties in the following cases: 
6.5.1. Users have agreed to such actions;

6.6.1. Federal law of 27.07.2006 № 152-FZ "On personal data»; 
6.6.2. Resolution of the Government of the Russian Federation of 01.11.2012 № 1119 "On approval of requirements for the protection of personal data during their processing in information systems of personal data»; 
6.6.3. Order of FSTEC of Russia of February 18, 2013 № 21 "On approval of the Composition and content of organizational and technical measures to ensure the security of personal data during their processing in information systems of personal data»; 
6.6.4 the Order of FSB of Russia of 10.07.2014 No. 378 "About the statement of Structure and the content of organizational and technical measures for safety of personal data at their processing in information systems of personal data with use of means of cryptographic protection of information necessary for accomplishment of the requirements established by the Government of the Russian Federation to protection of personal data for each of levels of security". 
6.6.5. The operator takes the necessary organizational and technical measures to protect the user's personal data from unauthorized or accidental access, destruction, modification, blocking, copying, distribution, as well as other illegal actions of third parties. 
6.6.6. The operator together with the User takes all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of personal data.
 
MANDATORY DATA RETENTION. 
7.1. The rights of Users provided for in this Policy may be limited in accordance with the requirements of applicable law. In particular, such restrictions may include the obligation of the Operator to retain the information changed or deleted by Users for a period established by law and/or to transmit such information in accordance with the legally established procedure to the state body.

INFORMATION ABOUT SECURING PERSONAL DATA. 
8.1. The operator appoints a person responsible for the organization of personal data processing to perform the duties stipulated by the Federal law "On personal data" and the normative legal acts adopted in accordance with it. 
8.2. The operator applies a set of legal, organizational and technical measures to ensure the security of personal data to ensure the confidentiality of personal data and protect them from illegal actions: 
8.2.1. Sets the rules of access to personal data processed in the information system of the Operator, as well as provides registration and accounting of all actions with them; 
8.2.2. Assesses the harm that can be caused to Users in case of violation of the Federal law "On personal data»; 
8.2.3. Identifies threats to the security of personal data when they are processed in the information system of the Operator; 
8.2.4. Applies organizational and technical measures and uses information security measures necessary to achieve the established level of personal data protection; 
8.2.5. Detects the facts of unauthorized access to personal data and takes measures to respond, including the recovery of personal data modified or destroyed as a result of unauthorized access to them; 
8.2.6. Assesses the effectiveness of measures taken to ensure the security of personal data before commissioning the operator's information system; 
8.2.7. Performs internal control of compliance of processing of personal data of the Federal law "On personal data", adopted in accordance with it regulatory legal acts, requirements for the protection of personal data, Policy, Regulations and other local acts, including control over the measures taken to ensure the security of personal data and their level of security during processing in the information system of the Operator.

INFORMATION ABOUT THE OPERATOR. 
9.1. Database containing personal data of Users – citizens of the Russian Federation
Federation, located on the territory of the Russian Federation. 
9.2. In order to exercise their rights and legitimate interests, Users have the right to contact the Operator by sending a request in person or with the help of a representative at the address specified in paragraph 1.1. Policies or to the email address provided on the Site. The request must contain information specified in part 3 of article 14 of the Federal law "On personal data".

CONSENT OF THE WEBSITE USER TO THE PROCESSING OF PERSONAL DATA.

Providing users of the site with access to special information.

The operator has the right to process my personal data in the following ways: collection, recording, systematization, accumulation, storage, update, change, use, transfer (distribution, provision, access).
 
This agreement shall enter into force and be valid for the period established by the current legislation of the Russian Federation (hereinafter - the Russian Federation). The condition for the termination of the processing of my personal data is the withdrawal of consent, the company's achievement of the goals of personal data processing, liquidation, reorganization, termination of the Company.
 
In all other respects, which are not provided for in this Agreement, the Operator and Users are guided by the privacy Policy (hereinafter – the Policy) and applicable laws of the Russian Federation. If the terms of this Agreement conflict with the terms of the Policy, the terms of the Policy shall apply.
