Parisian lawyers Karim Morad-Lahuazi and Victor Zaguri filed a lawsuit against Electronic Arts, RBC-Sport reports. Lawyers demanded that Ultimate Team mode be recognized as a gamble in the FIFA football simulator, which is released by EA.
Lawyers believe that the Ultimate Team, which has been one of the sections of the FIFA game since 2009, works on the principle of a casino. In Ultimate Team mode, players assemble a team from sets of cards sold by FIFA. The names of the players who fall into these sets are determined randomly. At the same time, users can buy and sell hotel cards to each other on a special platform.
“My client spent € 600 in five months without getting a single top player. The developers of this game mode have created an illusory and especially addictive system. The more you pay, the more chances you have to get a top player, ”said Zaguri.
Lawyers expressed their hope that the lawsuit against EA Sports will allow them to get an idea of the algorithm that generates the distribution of football player cards in sets.
The editors of FansHotline24 turned for comment to the leading lawyer of the European Legal Service Pavel Kokorev:
From the point of view of Russian legislation, gambling refers to a risk-based winnings agreement concluded between two or more participants, or with the organizer of the game according to the rules established by it (article 4 of the Federal Law dated December 29, 2006 No. 244-ФЗ "On state regulation of activities organizing and conducting gambling and amending certain legislative acts of the Russian Federation. "
There are no sufficient legal grounds for recognizing the Ultimate Team regime in the FIFA football simulator as a gamble in the Russian Federation. Buying cards to select a top player in a team does not give a right to win in the concept in which it is given by Russian law.
Winning in accordance with Federal Law No. 244-ФЗ is money or other property, including property rights, which are payable or transfer to a gambling participant when the result of a gambling occurs.
Selling some artifacts, items is quite common in online games, tanks, swords, armor are sold, considerable funds are sometimes spent on them by game participants, but such games cannot be considered gambling, at least in Russia. Recognition of such games as gambling is possible in the future in case of a change in the concept of gambling established by the Federal Law.
