The Ministry of transport of the Russian Federation came up with a proposal to ban the sale of spirits in free trains for the fans. All in all, 728 additional trains for 440 thousand seats have been allocated for the purposes of free transportation of fans during the World Cup.
"In order to maintain the quality of transport services, according to a letter from Russian Railways dated May 25, 2018, it is proposed to limit the sale of alcoholic beverages in these trains, allowing only alcoholic products to be retailed with ethyl alcohol content not more than 16.5%" - said Deputy Minister of Transport Alan Lushnikov in his letter to the Government. The Ministry of Transport asserts in this document that this proposal was previously agreed between Russian Railways and the Ministry of Internal Affairs of Russia.
Although the decision has not yet been made and it concerns alcohol products with an ethyl alcohol content of no more than 16.5%, FansHotline24’s editorial asked for comments from the leading lawyer of the European Legal Service, Mr. Ravil Gizyatov.
At the moment in accordance with the Federal law dated as November 22, 1995, No. 171-FZ "On state regulation of production and turnover of ethyl alcohol, alcohol and alcohol-containing products and on limiting consumption (drinking) of alcohol products" there are no bans on retail sale of alcohol products associated with the provision of catering services in dining cars. Also, in accordance with Presidential Decree No. 202 dated as May 9, 2017, "On the Specifics of the Application of Enhanced Security Measures during the FIFA World Cup 2018 in the Russian Federation and the FIFA Confederations Cup 2017" the authority to limit the sale of alcohol products has been transferred to administrations of host cities, in which there is a massive accumulation of people.
It is necessary to consider the fact that breaking this rule, namely the sale of alcohol by the carriage attendant, may result in disciplinary responsibility. If proven that such sale was carried out systematically, then there is a possibility of administrative liability for illegal business activity in a form of an administrative fine of five hundred to two thousand rubles.
Of course, no one guarantee the fans not carrying alcohol into the train. But it's forbidden to drink it on the train. Thus, in accordance with the Code of the Russian Federation on Administrative Violations dated as December 30, 2001, No. 195-FZ, consumption (drinking) of alcohol products in places prohibited by federal law may result in an administrative fine of five hundred to one thousand five hundred rubles. At the same time, if these actions are accompanied by a violation of public order, the authorities can take measures to "remove" the fan from the train and detain him/her.
