Electronic notification of an accident.

On September 1 of this year, the law came into force that drivers can now make a notice of an accident in electronic form.
What caused the innovation and how soon it will be able to assess the Russian drivers tells the publication invest-foresight leading lawyer of the European legal service Orest Matsala:
Today, drivers can arrange an accident by filling out the Euro Protocol, and not to call the traffic police, if as a result of a traffic accident, damage is caused only to vehicles and the collision occurred between two cars whose owners have a valid CTP policy. Drivers are obliged to fill in the paper form of the notice of road accident and within five days to send it to the insurance company.
A huge number of participants in the accident did not have time to send the form to the insurance company in time. The culprits did not send notice forms about the accident in the prescribed time, and later received recourse claims from the insurance company. Fortunately, in may 2019, the non-referral of the europrotocol within five days to their insurance company was excluded as a basis for filing a recourse claim.
The possibility of introducing an electronic procedure for filling out an accident notice was discussed for a long time in order to completely free the road accident participant from unnecessary paperwork. The RSA and the Central Bank of the Russian Federation came to a perfectly reasonable conclusion about the need to create a mobile application that is convenient for any driver to use and relieves him of the burden of paperwork with the loss of a temporary resource.
Representatives of the RSA explained that from September 1, the experiment will operate in Moscow, Moscow region, St. Petersburg and Leningrad region, and it is assumed that the data of the participants of the accident will be provided from a single portal of public services, and electronic notification of the accident, the data of CTP policies of participants and photos from the accident site will be online through the RSA system transferred to insurance companies.
It looks interesting. Today it is known that since September 1, 2019 the new edition of Art. 11. 1 of the law on CTP will operate. It provides for the possibility of issuing an electronic notice of an accident and States that there will be exceptions when the electronic form will be invalid.
From explanations of representatives of RSA it is clear how the Appendix has to work, and it is clear that since September 1 this norm will come into force, but the mechanism of use of this norm in provision on rules of CTP isn't registered yet, and there are questions which still remain unanswered today. We expect additions to the NPA.
If a resource with an address link is specified in The regulation on the CTP rules or in another document, in which drivers need to register, such an appeal will be considered an official notification of the insurance company about the occurrence of an insured event. It is optimal that the culprit of the accident did not have to go to the office of the insurance company to file a notification, and the victim had the opportunity to one-click to submit an electronic appeal to the insurance company and appear only for inspection of the vehicle and receive funds or directions for repair.
As for the application, it still seems to me that there is not enough clear menu with step-by-step filling of all necessary lines and the ability to set the geometry, time, date and photo fixation.
And in General, the permission to send an accident notice in electronic form should significantly reduce the time spent by drivers and minimize the negative regression consequences on the part of insurance companies.
